Commission Contract Terms and Conditions
Please read the full terms and conditions before deciding to purchase a commission.
By purchasing a commission it means that you agree with the following terms and conditions.
These terms and conditions apply to the commission services provided by Paolaillustrations to you, the client.
It is not necessary for the Client to have signed any document for these terms and conditions to apply.
Paolaillustrations has the right to deny any commissions, without needing to explain the reason. This includes during the commission process.
The Artist reserves the right to stop work on a Commission, or cancel a Commission request due to poor communication, inappropriate behaviour, or a breach of the Terms of Service.
Price
Price quotations for commissions will be decided and sent to yourself, the client by email after reading all information given regarding the commission.
Prices will vary depending on the detail and subject matter of the illustration.
This will be detailed within the cost breakdown within the commission contract.
Prices cannot be negotiated.
Price quotations are valid for up to 10 days after they have been sent to yourself, the client.
Price quotations will expire after 10 days and Paolaillustrations has the right to refuse and / or alter the quotation after this.
The client agrees to reimburse Paolaillustrations for any additional expenses incurred for the completion of the work. This include any extra postage charges etc.
Deposit
Paolaillustrations will require a deposit from the client to start the commission.
Paolaillustrations requires 50% of the full commission price upon starting the commission. 30% of this amount is non refundable due to time already being spent on the commission project.
If the commission is cancelled by yourself , the client, during the mid stage (the painting has been half completed) of the illustration, the excess 20% paid initially will also become non refundable.
This is because Paolaillustrations would have already spent time working on the illustration and will be reimbursed for said work.
The only instance in which this deposit would be refunded is in the case of Paolaillustrations deciding the commission would not be possible to create as an illustrator. However if this was the case, the commission would be denied before the commission is started.
If you (the Client) disagree with these terms and conditions or any part of these terms and conditions, you must notify the Illustrator before paying your deposit.
Non refundable payments are due to the time already spent on the project. Please be aware that commissions are treated alike hourly paid job roles. If time has already been spent on said commissions, then this time will have to be paid for, even in the case that the commission has been cancelled.
Paolaillustrations does not work for free.
Creating the Artwork
For the illustration to be created, images must be given to Paolaillustrations to use as reference. The client must have full permission to use such images and should not breach any copyright laws.
In some cases proof of ownership of images may be asked from the client.
Any images which do not follow the ethics of Paolaillustrations will be automatically denied. This includes any rude or disturbing imagery. Please look at my portfolio before purchasing a commission to understand the type of illustrations I create.
Before agreeing to a commission, the client should be familiar with the style of the artist and understand that the artwork will be an interpretation of the subject by the artist.
Once the Commission Contract has been agreed upon, Paolaillustrations will keep the client up to date through email.
The Commission Contract will include the brief (subject matter), timeline, final price with shipping price included etc.
Paolaillustrations will respond to all enquiries from a customer in a timely, professional and cooperative manner.
The client will then be asked to send over all reference images as well as any information. (This may be asked for before accepting the commission due to complex illustrations) It is encouraged to also send over any sketches to explain exactly as you want the illustration to look. Even if you cannot draw, any type of sketch would help greatly with composition and subject.
The first image sent to the client will be a pencil sketch. At this point the client should say any changes they want made. After this point it will be impossible to change any details.
All illustrations are created by traditional means of acrylic gouache. With this once started it cannot be erased or altered.
If you do not state what you want changed during the pencil sketch stage, Paolaillustrations will not be responsible for the outcome.
If the client does not like the outcome, the client is still responsible to pay for the commission.
During the first stages of painting, progress shots will be sent out to the client. During this time only minor alterations can be made.
Paolaillustrations reserves the right to share “painting in progress” photos to social media unless the Client expresses this not to be done.
Once complete, Paolaillustrations will email the client a watermarked final version of the illustration. After this, the final illustration will be sent out by post to the client.
Copyright
Paolaillustrations retains the copyright to the artwork created from the Clients photo. Paolaillustrations will not reproduce the Artwork & its usage will not be allowed on any other website apart from ‘paolaillustrations.com’ and social media pages, unless the Client gives written permission to do so.
Paolaillustrations reserved the right to display the artwork on their website and social media pages. If a Client is unhappy about the artwork being displayed, they must declare this upon placing the commission.
The Client retains ownership of the artwork but must obtain permission to share the artwork on social media. The client has no right to reproduce the artwork.
The artwork should only be used by yourself, the client, for personal use. These illustrations should be used for no other reason.

Payments
Invoices will be issued upon completion of the illustrations and must be paid in full before the final artwork is sent out.
Invoices will be sent by email.
There are no refunds for commissions. Once the contract has been signed and the non refundable deposit has been paid, the client will be expected to pay the final amount once the commission is completed. Not paying will cause a breach within the contract, as well as the final piece being not sent.
Payment is due in full within 7 days of receiving the invoice.
Paolaillustrations does not accept payment in part or via instalments.
Once you have received invoice you will be sent a link to a private page where your commission will be listed as item on my shop. This is how the client will pay for Paolaillustrations commission services.
Delivery
The Illustrator shall use her/his best endeavours to deliver the artwork to the Client by the agreed date and shall notify the Client of any anticipated delay at the first opportunity.
The illustrator shall not be liable for any consequential loss or damages arising from late delivery of the artwork.
The Client shall make an immediate objection upon delivery if the artwork is not in accordance with the brief. If such objection is not received by the Illustrator within 21 days of delivery of artwork it shall be conclusively presumed that the artwork is acceptable.
Termination before completion of commission / Rejection
Should the artwork fail to satisfy, the Client may reject the artwork upon payment of a rejection fee as follows:
(i) 50% of the agreed fee if the artwork is rejected at the rough stage.
(ii) 100% of the agreed fee if the artwork is rejected on delivery.
If the client chooses to terminate the services of Paolaillustrations after agreeing a commission arrangement but before the commissioned project is complete, Paolaillustrations reserves the right to retain any non-refundable deposits paid.
Do not start a commission if you know you will not be able to pay at the final stage.
If communication breaks down on the part of the Client for a period of 30 days (that is, the Client fails to reply to a communication from Paolaillustrations ) Paolaillustrations will issue a warning email. If this warning email is not replied to (and communication does not resume) with a following period of 30 days, Paolaillustrations reserves the right to to terminate the commission. In this event, all deposits paid will be retained by Paolaillustrations and the commission will be cancelled.
In the event of cancellation, ownership of all rights granted under this Agreement shall revert to the Illustrator unless the artwork is based on the Client’s visual or otherwise agreed.
If the Client wishes to continue the commission at a later date they will be required to request a new project quotation, sign a new Commission Agreement and pay a further non-refundable deposit.
Paolaillustrations is under no obligation to create a second commission if the customer is dissatisfied with the first. Paolaillustrations puts in complete effort in each illustration. Paolaillustrations would not create an illustration that the client would not be happy with.
These terms and conditions are governed by the law of England and Wales and may not be varied except by agreement in writing.
